Mumbai / New Delhi | August 03 2026: Ashim Deb, Founder of the Litigants Association of India (LAI), Mumbai, Maharashtra, has submitted a formal proposal seeking initiation of impeachment proceedings against the Chief Justice of India, Hon’ble Justice Surya Kant.

The proposal, emailed on Wednesday, 22 July 2026 at 11:07 PM UTC to the Hon’ble President of India and other dignitaries including the Secretary to the President, Ministry of Law and Justice, and parliamentary offices, invokes Articles 124(4) and 124(5) of the Constitution of India. It seeks impeachment on grounds of proved misbehavior, incompetence, and breach of constitutional trust.

The grounds listed are:

1. Suppression of Educational Freedom: The Hon’ble CJI, acting suo motu, compelled the Central Education Department to delete newly introduced curriculum material that sought to educate students about corruption in the judiciary. This is described as suppression of academic freedom and denial of citizens’ right to awareness under Article 19(1)(a).
2. Derogatory Remarks Against Unemployed Youth: In open court, the Hon’ble CJI referred to unemployed youth of the nation as “cockroaches.” Such remarks are stated to be unbecoming of the highest judicial office, violating the dignity of citizens and contravening the guarantee of equality under Article 14.
3. Failure to Protect Citizens Against State Brutality: On 20 July 2026, during a peaceful protest march from Jantar Mantar to Parliament organized by the CJP, police engaged in unlawful lathi charge, striking protesters on the head, tearing clothes of female participants, and causing grievous injuries. Despite a formal petition, the Hon’ble CJI dismissed the matter stating he “did not have time” and that such hearings were a “waste of time.” This is described as abdication of judicial responsibility and denial of Article 21 – Right to Life and Liberty.
4. Elevation Despite Pending Complaints: Multiple formal complaints against Hon’ble Justice Surya Kant remain undisposed. His elevation to the office of Chief Justice without resolution of these complaints is stated to undermine the integrity of the appointment process and erode public trust.

The proposal states that the Chief Justice of India is entrusted with safeguarding fundamental rights and upholding constitutional values, and that the above actions demonstrate proved misbehavior, incompetence, and breach of constitutional oath under Article 124(4). Continuation in office is said to threaten the credibility of the judiciary and the democratic fabric of the nation.

In a prominent statement, Ashim Deb, Founder, Litigants Association of India (LAI), said: “It is a constitutional call to protect the dignity of courts, restore public trust, and ensure accountability at the highest level.”

The prayer seeks that the Parliamentary Standing Committee take cognizance and recommend initiation of impeachment proceedings; that the President of India admit the proposal and direct Parliament to proceed under Article 124(4) for removal of Hon’ble Justice Surya Kant; and that, pending proceedings, the Hon’ble CJI be restrained from exercising judicial and administrative powers.

The proposal closes on a constructive note, affirming that it is offered not as an attack on the judiciary but as a constitutional effort to uphold the dignity of the courts, strengthen public trust, and promote accountability at the highest level — submitted purely in the public interest and in fulfilment of constitutional duty.
